Possession of Drug Paraphernalia and Other Charges Dismissed
Recently, I represented a client facing criminal charges for Possession of Drug Paraphernalia, Marijuana Possession and CDS in a Motor Vehicle. The facts of this case were as follows: Our client was driving through the town when he failed to observe a traffic signal. This prompted the police officers to initiate a motor vehicle stop. During the traffic stop, the officers alleged to have smelled marijuana emanating from the vehicle. My client consented to a search of the car and admitted to the officers that he had marijuana in his pocket and in the center console. My client arrested and charged with possession of marijuana, possession of drug paraphernalia and CDS in a Motor Vehicle. My client had multiple prior convictions for drug possession and was ineligible for any diversionary programs of leniency from the court. Marijuana Possession and Drug Paraphernalia possession each exposed my client to six (6) months the County jail and upwards of $1,500 in fines and court costs. Additionally, the ticket for CDS in a Motor Vehicle, under N.J.S.A. 39:4-49.1, required that my client lose his license for a mandatory 2 years. Suffice to say, my client was facing dire circumstances and would have lost his job, if found guilty.
Nevertheless, through multiple court appearances, I was able to obtain an outright dismissal of all the criminal charges. In the end, my client paid an $89 traffic ticket (with no points) and received an expedited expungement of the arrest in the courtroom that day. This was a shining example of how resilient and zealous legal advocacy can benefit our clients.
