Possession of Marijuana with the Intent to Distribute

For those individuals who are not caught in the act of selling but instead possessed a large amount of marijuana, they may be charged with Possession with Intent to Distribute. Under this section of the law, the Burlington County Prosecutor’s Office must prove that: (1) the Defendant possessed, or had under his/her control a quantity of marijuana; (2) the Defendant possessed the marijuana with the intent to distribute it; and (3) the Defendant acted knowingly or purposefully.

Marijuana Distribution

Distribution of marijuana requires that the Prosecutor prove that: (1) the Defendant distributed the marijuana on the day in question and (2) the Defendant acted knowingly or purposefully when distributing the marijuana.
“Distribute” means the transfer, actual, constructive or attempted, from one person to another of a controlled dangerous substance, in this case marijuana. This sale of drugs need not even involve an exchange of funds for the police to arrest your for marijuana distribution.
