Charges For Drunk Driving at Fort Dix
In 2019, the laws for Driving While Intoxicated were changed. While the length of suspensions for first, second and third offenses have been reduced, the penalties still include mandatory suspensions, ignition interlock device installation and incarceration. Pursuant to N.J.S.A. 39:4-50, the penalties are as follows for a first, second, and third or subsequent DWI offense.
DWI First Offense: If your BAC is at between .08% and .10%, you face a license suspension until you install an ignition interlock, which must remain on your car for at least three (3) months. If your BAC is between .10% and .15%, your license will be suspended until the interlock is installed and then will continue for seven (7) to twelve (12) months. If your BAC is .15% or above then there is a four (4) to six (6) month driver’s license suspension as well as installation of an ignition interlock for nine (9) to fifteen (15) months. There will also be fines up to $500, mandatory twelve (12) hours in the Intoxicated Resource Center (“IDRC”), up to 30 days in jail and a surcharge of $1,000 each year the next three (3) years.
DWI Second Offense: As you might imagine, second offenses carry a significant increase in the severity of penalties. Specifically, a second offense, regardless of your BAC, carries a one (1) to two (2) year license suspension, up to 90 days in jail, installation of an ignition interlock device for two (2) to four (4) years, 48 hours in the IDRC, up to a $1,000 fine, and a surcharge of $1,000 each year the next three (3) years..
DWI Third Offense: Finally, in the unfortunate event where you are facing a third or subsequent offense, the penalties include an eight (8) year license suspension, six (6) months in jail, a $1,000 fine, installation of an ignition interlock for two (2) to four (4) years following restoration (as well as during suspension), and a surcharge of $1,500 each year for the next three (3) years.
Refusal to Submit to a Breathalyzer Lawyer for Fort Dix
