Simple Assault Charges in Delran

Assault is a broad term that can refer to a variety of criminal conduct, including: Aggravated Assault, Simple Assault, Domestic Violence, Sexual Assault and Aggravated Sexual Assault. Most of these charges are felony indictable offenses in New Jersey that will be handled by the Burlington County Superior Court. If convicted of a felony offense, there is a possibility that you will be sentenced to a term of incarceration in a New Jersey State Prison, facing parole ineligibility and possible Megan’s Law Registration or Parole Supervision for Life (PSL). These types of assault will range between a first degree crime, second degree crime, third degree crime and fourth degree crime. However, Simple Assault, which happens to be the most common form of criminal assault in New Jersey, happens to be a disorderly persons offense (commonly referred to as a “misdemeanor”). This means that Simple Assault cases in Delran will be heard by the Delran Municipal Court. As a disorderly persons offense, Simple Assault does not carry the possibility of State Prison (though county jail is possible).   1. Make, or cause to be made, a communication or communications anonymously or at extremely inconvenient hours, or in offensively coarse language, or any other manner likely to cause annoyance or alarm
  2. Subject another to striking, kicking, shoving, or other offensive touching, or threaten to do so
  3. Engage in any other course of alarming conduct or of repeatedly committed acts with purpose to alarm or seriously annoy such other person.

In you are charged with harassment and either plead guilty or are found guilty, then the court will sentence you in accordance with the law. This means that a conviction for harassment carries the following penalties: up to thirty (30) days in the Burlington County Jail, a $500 fine, possible probation, court costs and a criminal record. However, depending upon the nature of the charges and your criminal history, we may be able to apply you for a diversionary program so that you can walk away without any criminal conviction on your record.

DWI Charges in Delran, NJ

While technically considered a traffic violation and prohibited under N.J.S.A. 39:4-50, Driving While Intoxicated (commonly called a DWI or DUI), is the most severely penalized traffic ticket in New Jersey. While New Jersey remains on the edge of legalizing marijuana, it is still technically illegal to possess, consume, use or distribute marijuana in Delran, New Jersey. Even if marijuana becomes legalized, there will still be restrictions on how much you may possess or have on your person at any given time. Until then, you must remain in compliance with New Jersey’s Criminal Code and N.J.S.A. 2C:35-10(a)(4) which states that it is illegal to possession marijuana. If you are found in possession of marijuana during a motor vehicle stop, you could be subject to jail time, up to a $1,000 fine, probation and a criminal record. Additionally, if you are driving a car with marijuana in your possession, you may also be charged with CDS in a Motor Vehicle. This is the traffic ticket equivalent of the criminal charge for marijuana possession except it carries a mandatory two (2) year suspension of your driver’s license.
